Exclusion of landlord's obligation to remedy defects (art. 7:206 BW)
For residential leases, Article 7:209 BW provides that the landlord's obligation to remedy defects under art. 7:206 BW cannot be excluded or limited to the detriment of the tenant (dwingend recht).
Exclusion of tenant's statutory protection against termination
Tenant protection (huurbescherming) under Articles 7:271-7:282 BW is mandatory law (dwingend recht) for residential tenancies. The landlord can only terminate on the statutory grounds listed in art. 7:274 BW. Any clause excluding this protection is void.
Rent increase exceeding statutory limits (regulated sector)
For regulated tenancies (gereguleerde/sociale huur), the annual rent increase is capped by the government. For 2024, the maximum increase is 5.8% for income-dependent increases or inflation + 1% for standard increases. Exceeding these limits is void.
