What's prohibited

  • Terms on the 'black list' of art. 6:236 BW (in consumer contracts)

    Article 6:236 BW lists terms that are always considered unreasonably onerous (onredelijk bezwarend) in consumer contracts and are therefore void. These include: terms depriving the consumer of the right to performance, terms allowing the user to terminate without notice, terms binding the consumer longer than 1 year without ability to terminate monthly, etc.

  • Complete exclusion of the duty of care (art. 7:401 BW)

    The duty to act as a good contractor (goed opdrachtnemerschap) under Article 7:401 BW is a core obligation. While the standard of care can be defined, a complete exclusion would likely be contrary to good faith (art. 6:248 lid 2 BW).
